By creating an account or using Find Albi ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must be at least 18 years of age to use Find Albi. By using the Service, you represent and warrant that you meet this age requirement.

Find Albi is an AI-powered dating coach that provides:

• Profile Coaching: AI analysis and feedback on your dating profile text and photos.
• Social Gym: Practice conversation simulations with AI-generated personas across multiple interaction modes (text, audio, video, and in-person roleplay).
• Performance Reports: AI-generated assessments of your practice sessions.

The Service is designed for educational and practice purposes only. Find Albi does not guarantee dating success, matches, or any specific outcome from using the Service.

YOU, THE BUYER, MAY CANCEL THIS AGREEMENT, WITHOUT ANY PENALTY OR OBLIGATION, AT ANY TIME PRIOR TO MIDNIGHT OF THE ORIGINAL CONTRACT SELLER'S THIRD BUSINESS DAY FOLLOWING THE DATE OF THIS CONTRACT, EXCLUDING SUNDAYS AND HOLIDAYS.

To cancel, you may:

• Delete your account at any time from Settings > Delete My Account, which immediately and permanently removes all your data.
• Contact us at legal@findalbi.com with the subject line "Cancel Agreement."
• Cancel your subscription through your app store account settings (Apple App Store or Google Play) or through the Service.

You are not required to provide a reason for cancellation. Any amounts charged within the cancellation period will be refunded in full within ten (10) business days.

Relief from Payment Obligations: In accordance with California Civil Code § 1694.2, you shall be relieved of any further payment obligations under any paid subscription if you:

• (a) die or become disabled and unable to use the Service, upon providing written notice and, if applicable, a physician's certificate;
• (b) relocate your principal residence more than fifty (50) miles from your prior residence, upon providing written notice and proof of relocation.

Relief shall take effect upon Find Albi's receipt of written notice. Any prepaid amounts for the remaining subscription period shall be refunded on a pro-rata basis within ten (10) business days.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior.

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Submit content that is defamatory, obscene, or promotes violence or hatred
• Attempt to reverse-engineer, decompile, or extract the source code of the Service
• Use the Service to develop competing products or services
• Circumvent any access restrictions, rate limits, or security measures
• Share your account credentials with others
• Use automated scripts, bots, or scrapers to access the Service
• Misrepresent your identity or impersonate another person

You retain ownership of all content you submit to the Service (profile text, photos, chat messages). By submitting content, you grant Find Albi a limited, non-exclusive license to process this content solely for the purpose of providing the Service.

You are solely responsible for the content you submit. Do not submit content that you do not have the right to share or that contains personal information about third parties without their consent.

We reserve the right to remove content that violates these Terms.

FIND ALBI IS AN AI COACHING TOOL, NOT A LICENSED THERAPIST, COUNSELOR, RELATIONSHIP EXPERT, OR MATCHMAKER.

IMPORTANT: ALL PERSONAS IN THE SOCIAL GYM ARE ARTIFICIALLY GENERATED BY AI. They are not real people. No human is on the other end of any practice conversation. These AI personas are computer-generated characters designed to simulate dating scenarios for educational purposes. A reasonable person should understand that all responses, personalities, and behaviors displayed by these personas are entirely synthetic and algorithmically produced.

AI-generated coaching feedback, practice conversations, and performance reports are provided for educational and entertainment purposes only.

You acknowledge that:

• AI suggestions may not always be appropriate for your specific situation
• You use AI coaching advice at your own discretion and risk
• The Service does not provide professional psychological, therapeutic, or medical advice
• AI responses may occasionally contain errors or inappropriate content

Find Albi maintains protocols for detecting and addressing expressions of suicidal ideation, self-harm, or acute emotional distress during AI interactions. If our systems detect such content:

• The AI will cease roleplay and provide a supportive, non-diagnostic response
• The user will be directed to professional crisis resources, including:
  • 988 Suicide & Crisis Lifeline: Call or text 988 (US)
  • Crisis Text Line: Text HOME to 741741
  • International Association for Suicide Prevention: https://www.iasp.info/resources/Crisis_Centres/

Find Albi is not a substitute for professional mental health care. If you are in crisis, please contact one of the resources above or call your local emergency number immediately.

The AI personas are not trained to provide therapeutic support, and no AI interaction within the Service should be relied upon for mental health guidance.

Find Albi offers both free and paid subscription tiers.

Free Tier: Subject to daily usage limits as described in the Service. No payment required.

Paid Subscriptions (Find Albi Pro):

AUTOMATIC RENEWAL NOTICE — PLEASE READ CAREFULLY:

Your Find Albi Pro subscription will automatically renew on a monthly basis and you will be charged the then-current subscription price each month until you cancel. The subscription fee is charged at the beginning of each billing cycle through your app store (Apple App Store or Google Play) or through Stripe.

How to cancel your subscription:

• Apple App Store: Open Settings > tap your name > Subscriptions > Find Albi > Cancel Subscription
• Google Play: Open Google Play > Menu > Subscriptions > Find Albi > Cancel
• Web (Stripe): Go to Settings within the Find Albi app and select "Manage Subscription," or email legal@findalbi.com with the subject line "Cancel Subscription"

Cancellation takes effect at the end of the current billing cycle. You will retain access to Pro features until that date. No partial-month refunds are issued for mid-cycle cancellations unless required by law.

Refunds for app store purchases are handled according to the policies of the applicable app store. For Stripe-processed subscriptions, contact us within 14 days of charge for a refund.

We reserve the right to change pricing with at least 30 days' written notice. Price changes will not take effect until the start of the next billing cycle after notice.

Consent Records: In accordance with the California Automatic Renewal Law (Bus. & Prof. Code § 17600 et seq.), Find Albi retains records of your affirmative consent to automatic renewal terms for a minimum of three (3) years or the duration of the subscription relationship, whichever is longer.

All software, designs, algorithms, AI models, coaching methodologies, and content created by Find Albi ("Company IP") remain the exclusive property of Find Albi. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

You may not copy, modify, distribute, sell, or create derivative works based on the Service or any Company IP without prior written permission.

Ownership of AI-Generated Coaching Content. AI-generated coaching feedback, performance reports, grades, and recommendations ("Coaching Outputs") may not qualify for statutory copyright protection due to the absence of human authorship under applicable law (including U.S. Copyright Office and U.K. CDPA guidance). Regardless of statutory copyright eligibility, the parties agree by contract as follows:

• Coaching Outputs generated for you (your personal performance reports, grades, and personalized feedback) are owned by you. You may retain, review, and use them for your personal purposes.
• The underlying systems, prompts, methodologies, and AI models used to generate Coaching Outputs remain Company IP.
• Neither party may register copyright in Coaching Outputs that lack sufficient human authorship to qualify for copyright protection.

This contractual allocation of ownership applies regardless of whether any jurisdiction recognizes copyright in the relevant Coaching Outputs.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIND ALBI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

FIND ALBI EXPRESSLY DISCLAIMS ALL LIABILITY FOR:

• Any actions you take based on AI coaching suggestions
• Any communications or meetings with third parties arranged as a result of using the Service
• Emotional distress or psychological harm
• Any damages resulting from unauthorized access to your account
• Service interruptions, bugs, or data loss

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

FIND ALBI DOES NOT CONDUCT BACKGROUND CHECKS ON USERS AND MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, OR ACCURACY OF AI-GENERATED CONTENT.

You agree to indemnify and hold harmless Find Albi, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by using the "Delete My Account" feature in Settings, which permanently removes all your data.

Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions.

Arbitration Agreement. Subject to the exceptions below, any dispute, claim, or controversy arising out of or relating to these Terms or the specific Service provided under these Terms at the time of the dispute shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, conducted in San Francisco, California or via telephone/video at your election.

Scope Limitation (SB 82 Compliance): This arbitration agreement applies solely to disputes arising from or relating to the Service as described in these Terms. It does not extend to disputes arising from other products, services, or agreements not covered by these Terms.

Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive any right to participate in a class, collective, or representative action.

Small Claims Exception: Either party may bring an individual action in small claims court for disputes within that court's jurisdictional limits.

Arbitration Fee Payment (SB 707 Compliance): If Find Albi initiates or is required to pay arbitration fees, failure by Find Albi to pay such fees within thirty (30) days of the due date constitutes a material breach of this arbitration agreement and a waiver of Find Albi's right to compel arbitration. In such event, you may elect to proceed in court and Find Albi shall be liable for your reasonable attorneys' fees and costs incurred as a result of the breach.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to legal@findalbi.com within thirty (30) days of first accepting these Terms. Your notice must include your name, email address associated with your account, and a clear statement that you wish to opt out of arbitration.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms within the app and updating the "Last Updated" date at the top. For material changes to the arbitration agreement, subscription pricing, or cancellation rights, we will provide at least thirty (30) days' advance notice via email or in-app notification. Your continued use of the Service after the notice period constitutes acceptance of the updated Terms.
